Terms & Conditions

The carrying out by Splendid Settings ("We" or "us" or "our") of your Rental Order is subject to the following terms and conditions. These terms and conditions, together with your Rental Order comprise the entire agreement between you and us. "You" or "your" refer to the renter listed in the Rental Order. Unless defined below, capitalized terms used below have the meanings set out in the Rental Order.

Our Obligations

Rental: We will rent to you the Rental Items listed in the Rental Order for the purpose of your Event, only.

Delivery: We will deliver to you and pick up from you, the Rental Items listed in the Rental Order on the dates listed in the Rental Order. Unless otherwise indicated in the Rental Order, we will deliver on the day of your Event and pick-up on the day following your Event.

Limitation of Liability: Our liability will be limited in two ways. Firstly, in no event will our liability arising out of or related to our agreement, for any reason, exceed the total amounts paid by you to us under our agreement. Secondly, in no event will we be liable to you or to any third party for any consequential, incidental, indirect, exemplary, special, aggravated or punitive damages whether arising out of breach of our contract, tort (including negligence) or otherwise.

Your Obligations

Cooperation: You will provide  all necessary cooperation to allow us to carry out our obligations (discussed above), including: (i) providing us access to the location of your Event and (ii) to ensure that you or your agents are available to receive the Rental Items when delivered. We cannot be responsible for any delays caused by any failure by you to provide such cooperation, and you may be subject to an additional delivery charge if we are unable to deliver or pick-up the Rental Items at the agreed date and time.

The price for delivery is based on the understanding that the items will be ready for pick up in the same containers used to deliver them, and the items will be gathered in a single location which is easily accessible to the driver.  If the rentals are not ready for pick-up; if the driver has to locate items in different locations around the venue/home, or has to separate our Rental items from other companies' rentals, additional fees will apply.

Charges and Payments: You are responsible for paying all fees, charges and deposits listed in the Rental Order, including rental and delivery charges and the Security Deposit (discussed below). Other than the Non-Refundable Deposit (described below), all such amounts will be payable by you no less than one week prior to the date of your event by such a method of payment that you and we agree to.

Adjustment to orders: You can make adjustments to your order up to 10 days prior to your event without penalty. We will do our best to accommodate any last minute additions to your order. Additional charges may apply.

Non-Refundable Deposit / Cancellation: A Non-Refundable Deposit is required to guarantee the availability of the Rental Items. You will be required to provide us the Non-Refundable Deposit indicated in the Rental Order at the time of booking. Cancellation of your Rental Order at any time by you will result in the forfeiture of the Non-Refundable Deposit.

Damage or Loss of Rental Items/Security Deposit: All risk of damage or loss to the Rental Items will pass to you from the time of delivery until they are picked-up (as described above). You are responsible for ensuring that all Rental Items will be available for pick up by us in the quantities and quality in which they were delivered. You will be liable for the replacement cost of damaged or lost Rental Items. In order to cover such possible costs, you are required to provide us with your credit card information at the time of your order (even if not paying by credit card). Assessment of breakage, loss, or damages following your event may take up to 10 business days.

Please note: Our drivers do not count glassware, dinnerware, and flatware items on-site for sanitary reasons. It is the responsibility of the client to ensure all items are accounted for at the time of pick-up.

Inventory Recovery Fee: A mandatory 5% charge for inventory recovery will be applied to all contracts and covers moderate wear and tear from normal use. The damage waiver does not cover breakage, loss, or damage that may occur while items are in the possession of the client.

Indemnification: You will indemnify, defend, and hold harmless us and our officers, directors, employees and agents, from any and all damages, liabilities, actions, suits, claims, costs (including reasonable legal fees), penalties, or expenses arising out of or in connection with a breach by you of our agreement or resulting from the actions or omissions or you or any of your agents or other suppliers of goods and services with respect to your Event.
